1. Introduction: Welcome to Bodybrand, LLC (“Company”, “we”, “our”, “us”)!
These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at Pinkdragon.app (together or individually “Service”) operated by Bodybrand, LLC, which includes the following websites: hollydolke.com, pinkdragon.app, platform.pinkdragon.app, platform.pinkdragon.studio (hereinafter, the “Website(s)”).
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Your agreement with us includes these Terms and our Privacy Policy (“Agreements”).
You acknowledge that you have read and understood Agreements, and agree to be bound of them. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at hello@hollydolke.com so we can try to find a solution.
These Terms apply to all visitors, users and others who wish to access or use Service.
2. Communications: By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at hello@hollydolke.com.
3. Purchases: If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Contests, Sweepstakes and Promotions: Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service.Participation in any Contest, Sweepstakes and Promotion is voluntary. To participate in a Promotion, you should follow the instructions set out in the relevant Promotion Communication, on the individual web landing page for that Promotion and, where appropriate, the applicable Specific Promotional Terms. Unless otherwise indicated in the applicable Specific Promotional Terms, entry into each Promotion may be used only once.To be eligible to participate in any Promotion, you must: (a) be eighteen (18) years of age or older, or the legal age of majority in your home country, state or province; (b) be legally entitled to use Our services in accordance with Our Terms and Conditions of Use; (c) if the Promotion is specifically intended for participants who are residents of and/or located in a particular country as stated in the applicable Specific Promotional Terms, be a resident of and/or located in that country; (d) unless the applicable Specific Promotional Terms indicate that a “no purchase necessary” route is available, have successfully completed registration on the platform for the relevant service;(e) satisfy any other eligibility criteria set out in the relevant sections of these Standard Promotional Terms in respect of certain general categories of Promotion and in the applicable Specific Promotional Terms;
5. Subscriptions: Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Bodybrand, LLC cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting hello@hollydolke.com customer support team.A valid payment method is required to process the payment for your subscription. You shall provide Bodybrand, LLC with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Bodybrand, LLC to charge all Subscription fees incurred through your account to any such payment instruments.Should automatic billing fail to occur for any reason, Bodybrand, LLC reserves the right to terminate your access to the Service with immediate effect. Studio membership is our annual subscription. It entitles members to all Pink Dragon programs or challenges currently available, and any new ones that get released in the App/Web App. Any Guides or PDFs or additional bonuses are not automatically included in Studio membership but can be added on, dependent on the current Pink Dragon pricing.
6. Free Trial Bodybrand, LLC may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”).You may be required to enter your billing information in order to sign up for Free Trial.If you do enter your billing information when signing up for Free Trial, you will not be charged by Bodybrand, LLC until Free Trial has expired. On the last day of Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.Bodybrand, LLC reserves the right right to not allow two back to back free trials. At any time and without notice, Bodybrand, LLC reserves the right to (i) modify Terms of Service of Free Trial offer, or (ii) cancel such Free Trial offer.
7. Fee Changes Bodybrand, LLC, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Bodybrand, LLC will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
8. Challenge/Competition: These competition rules cover any Pink Dragon product with ‘Challenge’ or ‘Accelerator’ in the name. Prices for entering the competition/challenge are date-dependent, with early bird entries having significant bonuses. Pricing will be applied accordingly based on internal Pink Dragon pricing regulations.Studio members have access to every program that is available in our App/Web App automatically as they are launched. Any additional bonuses or features, whether PDFs, VIP emails, or accountability emails, plus more, are excluded from the Studio membership but may be available at an special add-on rate for Studio members.Studio members are able to take part in the competition element of the ChallengeVIP emails are only available for the duration of the competition/Challenge/for 12 weeks from day of purchase. This applies to Studio members too. VIP emails provide you with a guaranteed 24-hr reply to any email, offering general support and advice relevant to the challenge. Pink Dragon can not be held liable for any injury, illness, or death related to the challenge or advice given, and you should always seek advice from a medical professional for any health queries.We offer a 30 day Money Back Guarantee on the Challenge which is valid from the date of purchase. After 30 days refunds cannot be provided for any reason on the Challenge, or on any PDFs or partial element of the package purchased.Challenge video and nutrition content may be reused from previous Pink Dragon programs.Access to the challenge is provided in the App/Web App for the duration of the competition after it will be removed from the App/Web App. This does not apply to Studio members.
Competition winners - 5 winners announced 4 weeks after the challenge ends via the Pink Dragon Instagram account. Winners will be emailed, and prizes will need to be claimed within 7 days with full shipping details needing to be provided by the winner.Competition winners will be decided by 8 judges from the Pink Dragon team Competition prize can be amended at Pink Dragon’s discretion Competition rules: 1. You need to take a ‘before’ photo at the start of the challenge, and an ‘after’ photo at the end of competition2. These need to be emailed to competition@hollydolke.com on the final day along with a screenshot of the challenge completed in your app. Pink Dragon reserve the right to eliminate any participants from the competition for any suspected breach of the rules.4. Only one competition entry is allowed at any one time per person, if concurrent competitions are running.
9. Refunds: No refunds will be issued once the payment has been processed. We do not offer refunds or credits for change of mind, unused subscription periods, accidental purchases, medical conditions, medical conditions, or any similar reason or event. We do not offer a money back guarantee for subscriptions. The subscription can be cancelled at any time, which will prevent any further payments from being processed.We do not offer any refunds on digital products, unless the digital product available for download after a purchase is faulty, in which case a replacement or a refund is available if we are unable to fix the faulty product. We will offer a refund if there is a Money Back Guarantee as part of the Offer, as long as it is claimed within the deadline i.e. 30 or 60. days and with any applicable conditions fulfilled.Refunds for subscriptions are not available. Customers who purchase products in a bundle (a pack of 3, or a pack of 6) must return all of the un-used products purchased. Returned products must be closed and sealed.**60 day money back guarantee is only a limited time offer and can only be granted if product is returned within 60 day time frame. 60 days starts from the date of purchase, not the date that the product was received by customer. *Each protein container contains 450g and has 15 servings. All fees imposed during or after shipping are the responsibility of the customer (tariffs, customs, taxes, etc.). International customers, we recommend you use a customs calculator to determine the approximate cost that may be accrued at customs.Refunds Purchases that meet the above return policy guidelines will be refunded back to the original method of payment. We will issue your refund once your return arrives in our warehouse and has passed our quality test. Note that it can take 7-10 business days for your refund to show up in your bank statement. If you have not received your refund after 10 business days, please email us and we would be happy to check on the status for you. Purchases received outside of the Standard Return & Refund Policy Guidelines will not be mailed back and will not be refunded.Damaged products/goodsOnce you receive your item(s) you must check them prior to opening for any damage before use. If your product(s) is damaged upon receiving it, or it is the incorrect product we ask that customers take a photo and contact us within 48 hours of receiving it at returns@hollydolke.com with their invoice number and photo of the item. We will let you know exactly what to do and how to return the damaged or incorrect product. We will arrange for an exchange for the correct item. Customers may not dispose or throw away the incorrect/damaged item. We will cover transport costs involved in replacing/exchanging the damaged or incorrect item. We reserve the right to ask you to send us the incorrect/damaged item before we can send a replacement or exchange. If the incorrect item is sent and the error is ours, we will cover the transport fees/shipping. If the item is damaged while in transportation or due to a carrier error, the customer will cover the transport fees/shipping. We are not responsible for stolen, or lost itemsIf you have any concerns about your order please contact us at returns@hollydolke.comFAQ’s:How long will it take for my product to arrive, what are shipping times?Generally, Domestic (EU) shipping takes 2-5 days. International shipping takes 6-15 days depending on where you are in the world. We cannot guarantee shipping times for domestic or international customers at this time. We reserve the right to terminate the account of anyone found to be infringing on a copyright.You retain any and all of your rights to any Content you submit, post or display on or through Service and you are responsible for protecting those rights. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. Please note that for technical issues, our development team might require 24-48 hours to resolve the problem.
11. Prohibited Uses: You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:0.1. In any way that violates any applicable national or international law or regulation.0.2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.0.3. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Bodybrand, LLC.
16. Copyright Policy: We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to hello@hollydolke.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.17.
